ينظم القانون المصري مسألة فسخ عقد الإيجار لعدم سداد الأجرة بدقة. القاعدة العامة هي أن عقد الإيجار يُفسخ بقوة القانون إذا تضمن عقداً يُعرف بـ "الشرط الفاسخ الصريح"[1].

ولكن، لتفعيل هذا الشرط، يجب توافر الشروط التالية:

  • وجود شرط صريح بالفسخ: يجب أن ينص العقد بوضوح على أن العقد يُعتبر مفسوخاً من تلقاء نفسه دون حاجة إلى حكم قضائي[2].
  • الإنذار الرسمي: يجب توجيه إنذار رسمي للمستأجر بضرورة سداد الأجرة المتأخرة، وإعطائه مهلة معقولة للسداد قبل اللجوء للفسخ[3].
